On June 15, 2020, the U.S. Supreme Court issued a decision in three consolidated cases: Bostock v. Clayton County, Altitude Express Inc. v. Zarda, and R.G. Harris Funeral Homes Inc. v. EEOC. The issue in each case revolved around the meaning of “sex” in the Civil Rights Act of 1964 and whether discrimination because of “sex” covers discrimination or harassment based on sexual orientation and gender identity, not just based on being a man or a woman. The Supreme Court found that it did, leading to protection in the workplace, under federal law, from harassment or discrimination based on sexual orientation or gender identity.
