This presentation outlines the proposed “Safe to Work” Act, which imposes strict nationwide limitations on COVID-19 related tort liability.  The limitations are retroactive from December 1, 2019 and extend to October 1, 2024. 

The presentation also reviews state laws that limit COVID-19 related civil liability for businesses.  Employers should be aware of federal and state laws in order to comply.  To the degree that compliance with the laws causes a change in the terms and conditions of employment for union workers, employers may have an obligation to notify and/or bargain with the union over the changes.    This presentation recommends a step by step plan for the implementation of such policies, and provides COVID-19 leave law case studies.
